The Big Thing You Need To Know This Week
Reuters: Some companies alter diversity policies after conservatives' lawsuit threat

WHAT’S HAPPENING? 

At least six major U.S. companies including JPMorgan Chase have modified policies meant to boost racial and ethnic representation that conservative groups threatened to sue over, a new report by Reuters found.


Yesterday, America First Legal, led by Former Trump adviser Stephen Miller, requested the nation’s top federal civil rights agency investigate IBM over diversity-focused employment and executive pay policies that they say comprise illegal sex and race discrimination, according to Bloomberg.


WHERE DID THIS COME FROM? 

Groups opposed to the corporate DEI movement have been emboldened by last summer’s Supreme Court ruling striking down affirmative action in education. Ever since, activists have accused companies like Macy’s, McDonald’s and NASCAR of denying white Americans opportunities so that corporations can hire and promote more people of color to achieve their diversity goals.


WHAT DOES ELON MUSK HAVE TO SAY ABOUT IT?

The question on everyone’s mind! “Diversity, equity and inclusion are propaganda words for racism, sexism and other -isms,” Elon Musk posted to X. “This is just as morally wrong as any other racism and sexism. Changing the target class doesn’t make it right!”

WHY DOES IT MATTER? 

The letters allege certain DEI policies expose the companies to legal risks and must be abandoned or the groups will sue to hold the directors liable, the Reuters report says. Shareholders can sue when directors have failed in their duties, such as oversight, but corporate law protects directors' good-faith decisions from lawsuits, creating a high legal bar for the groups' claims if they ever go to court.
